Standard Grant Conditions For Organisations
1. The grant must only be used for the purpose(s) detailed in your application form and in any supplementary information. If the grant is used for any other purpose(s), without written permission from us, we may require you to repay the grant.
2. You may not transfer or assign any part of this grant to another charity, organisation or individual.
3. The grant must only be used for the benefit of people living Herefordshire.
4. If there is a change in circumstances which means that it is no longer possible for the grant to be spent for the purpose it was originally awarded, you must notify us immediately in writing. If the grant cannot be spent in compliance with our conditions, then we reserve the right to cancel the grant award and to require you to repay all or part of the grant.
5. If for any reason the funded project has not commenced within 12 months of the grant being awarded or if you fail to make sufficient progress on the project funded by the grant award, then we reserve the right to cancel the grant award and require you to repay all or part of the grant. The decision on whether sufficient progress has been made is entirely at our discretion.
7. If your grant offer has specific conditions attached and you fail to meet those conditions, we reserve the right to withdraw the offer of funding and to cancel future grant payments.
8. You are required to tell us if your organisation receives duplicate funding for the elements of your project funded by us and we may require you to repay some or all of the grant award.
9. We reserve the right to withhold payment of the grant and/or require repayment if any deliberately false or misleading information is provided in support of the application or during the grant monitoring process.
10. The grant is not consideration for any taxable supply for VAT purposes by your organisation to us. If an HMRC investigation determines that there is a VAT liability, we accept no responsibility for such liability.
11. You must repay to us immediately any VAT that you recover to the extent that any such VAT cost was included in our grant to you for this project.
12. Our grant must be recorded in your organisation’s accounts or accounting statement. We reserve the right to see the books and records relating to the award given to your organisation and you are required to keep accurate and comprehensive records of how the grant has been spent.
13. You will inform us of significant matters, including but not limited to:
• A change in your structure (to become a CIO for example).
• planned mergers
• closure of the service/s we funded
• safeguarding concerns
• fraud (whether or not it affects the funded project)
• changes of key personnel such as the Chair of Trustees, CEO or Project Lead on major projects.
• all Serious Incidents reported to the Charity Commission
14. We reserve the right to cancel or suspend your grant award if your organisation does or fails to do something which affects our good reputation or puts charitable funds at risk.
15. We reserve the right to withhold the grant if your charity becomes insolvent, or goes into administration, receivership or liquidation if the grant has not, at the time of any of these events occurring, already been spent on its intended purpose.
16. You must send us a report on the funded project and/or your charity’s activities at the end of the grant period. Guidelines are on our application form.
17. We may publish summary details of grants awarded on our website, press releases, social media and on other websites, databases and reports that are available to the general public.
18. We, our Trustees and officers accept no liability for any costs or consequences incurred by you or third parties that arise either directly or indirectly from the activities of your organisation, nor from non-payment or withdrawal of the grant. If the grant award contributes towards the costs of a staff post, we do not assume any of the responsibilities of an employer nor are we to be regarded as such.
19. The giving of a grant by us under these Grant Conditions does not create a contract with the recipient(s) and the recipient’s(s’) right to the grant cannot be enforced in a court of law.
20. The law of England and Wales governs these Grant Conditions.
